Uncontested Divorce

In Massachusetts, a married couple can file for an uncontested divorce if both parties are in agreement on the division of marital assets, spousal maintenance, and all child custody issues. If you both come to an agreement on all financial and divorce-related issues without the court's help, Bentley Law Group LLC's flat-fee uncontested divorce package is all that's necessary to handle your Massachusetts divorce.

Upon retention of Bentley Law Group LLC to file your uncontested divorce, we will draft a separation agreement consistent with Massachusetts law that addresses the minimum alimony (spousal support), division of marital property, assets, and debt. For those with children, the separation agreement will address child support and child custody and will include a parenting plan.

Contested Divorce

A divorce is contested if you and your spouse are not in agreement on one or more issues relative to your case, such as marital asset division, spousal maintenance, and all child custody issues. This is different from an uncontested divorce because the divorcing parties are unsettled on all matters incident to divorce.

For this reason, contested divorce proceedings take much more time due to the fact that a judge must resolve any major disagreements between the parties. The attorneys in a contested divorce spend time preparing for trial and in pre-trial hearings. The costs can vary widely depending on which law firm you choose.

In all cases, Attorney Bentley of Bentley Law Group LLC encourages you to work out settlements that will be beneficial to your interests. We offer a number of alternative dispute-resolution techniques, including collaborative law and mediation. Despite this, there are times when settlements cannot be reached, and we're prepared to go to court to protect you.

In most cases, the parties find a way to resolve their issues before going to trial, and our firm strives to help you avoid the high costs of divorce litigation whenever possible.

If you and your spouse are unable to reach an agreement on issues pertaining to your divorce, please contact Bentley Law Group LLC. Our firm will help you devise a strategy to find a middle ground.

Modification Cases

Agreements relating to divorce or custody issues many times will need updating. If there has been a change in your life’s circumstances, you can file a complaint for modification, a motion for reconsideration, or an attempt to set aside a previous verdict.

Attorney William “Blake” Bentley of Bentley Law Group LLC handles a wide variety of modification cases involving a change in parenting plans, child support, and alimony. He works with all sorts of clients from low-income or middle-class to those with very high incomes and assets. He even has nine years of experience managing assets of high net-worth clients. At Bentley Law Group LLC, we can help tailor a legal solution for any need or any change in circumstance.

How to facilitate a change in your previous divorce, custody, or child support agreement depends on the status of your case and the change in circumstances presented to us. In some cases, you may only need to file a motion. In other cases, you may need to file a complaint starting the case toward a possible trial.

Let Attorney Bentley and the team at Bentley Law Group LLC evaluate the circumstances that may call for a change of your current court order or existing decree of divorce. we understand the methods that should be used to effect the modification in your particular court.
