Reckless Driving Attorney in Framingham, MA

If you've been charged with negligent operation of a motor vehicle in Massachusetts, this involves far more than a simple ticket. Receive the legal help you need in your negligent operation of a motor vehicle or reckless driving case when you call Bentley Law Group LLC.

In negligent operation cases, the police claim you drove a motor vehicle in a way that endangered lives and the safety of the public. Fundamentally, any deviation from the standard of flawless driving could result in a negligent operation charge.

Criminal misdemeanor charges for negligent operation or reckless driving could possibly lead to up to 2.5 years in state jail plus large fees and fines. In addition, if the case ends with a conviction, the charge could result in a sixty-day loss of license.

However, in many cases, a skilled defense attorney can resolve the case short of an admission of guilt on your part. Oftentimes, the case can be resolved with a payment of court costs, pretrial probation, or completion of a driver’s education program.

Don't make the mistake of not taking these cases seriously. Negligent operation or reckless driving charges should be handled with the assistance of a local Massachusetts defense attorney. Call Bentley Law Group LLC today at (508) 655-4546 for a free consultation.

Massachusetts Hardship Licenses

A hardship license can allow you to drive for set 12-hour periods as often as 7 days a week. In order to be granted a hardship license, you'll need to provide adequate documentation that you would suffer a considerable “hardship” without the use of your license. Hardships are only granted to Massachusetts license holders.

To apply for a hardship license, you must attend a hearing at an RMV Hearings Site. Registry hearings are held on a walk-basis from 9:00 AM to 4:30 PM Monday through Friday (except holidays) at the following Registry locations: Boston, Brockton, Lawrence, Springfield, and Worcester. Depending on the nature of your offense, most motorists will be eligible at varying times for a hardship license.

In standard cases, if convicted of a first-offense OUI or continuance without a finding, a motorist can apply three days after conviction for a hardship license. The Massachusetts Registrar of Motor Vehicles will consider individuals for hardship licenses in cases where the records indicate that a first offense disposition pursuant to G.L. c. 90 § 24D was legally appropriate.

Bentley Law Group LLC can assure you have the proper documentation required for you to be granted a hardship license. Please note, hardship licenses are not available if you have additional issues affecting your license or right to operate other than a chemical test refusal or failure attached to this first OUI offense.

A hardship license can also be obtained after a conviction of a second-offense OUI. Eligibility for a second offense OUI begins after one year of the two-year license loss for a Massachusetts OUI second offense. However, if your second offense OUI occurs 10 or more years after the first OUI offense, you are eligible for the “second chance first-offender” 24(D) Alternative Disposition program. This program allows an individual who has a prior OUI offense to be given a “second chance” and be treated as if s/he is a first-time OUI offender. Under this deal, the second-time offender could avoid the 14-day in-patient treatment program and the two-year license suspension typical in second-offender license suspensions.

Attorney Bentley is a Massachusetts criminal lawyer handling Registry of Motor Vehicles appeals, license matters, and suspension issues and can represent you at the Registry of Motor Vehicles or Board of Appeals. Attorney Bentley will assist you in gathering and preparing the necessary paperwork and then represent you at the RMV hardship hearing.
